Agreement to Terms

These Terms and Conditions (“Terms”) govern your use of the website bodycontouringmiami.com and the services provided by Body By Helen LLC, doing business as Body Contouring Co (“Company,” “we,” “us,” or “our”).

By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

Services

Body Contouring Co provides non-surgical body contouring, EMSculptone treatments, lymphatic drainage, massage therapy, and related wellness services at our location at 407 Lincoln Road, Suite 304, Miami Beach, FL 33139.

Our services are cosmetic and wellness treatments. They are not medical treatments and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Eligibility

You must be at least 18 years of age to use our services. By booking an appointment, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement.

Certain treatments may not be suitable for individuals with specific health conditions, including but not limited to pregnancy, pacemakers, metal implants, cancer, epilepsy, or certain skin conditions. You are required to complete a consultation form and disclose all relevant health information before receiving treatment.

Appointments and Cancellations

Appointments can be booked through our website, by phone at (786) 777-8674, or via WhatsApp at the same number.

Cancellation Policy

• Cancellations made 24 hours or more before the appointment: Full refund or reschedule at no charge
• Cancellations made less than 24 hours before the appointment: 50% cancellation fee
• No-shows: Full charge of the scheduled service

We reserve the right to cancel or reschedule appointments due to unforeseen circumstances. In such cases, you will receive a full refund or the option to reschedule.

Pricing and Payment

All prices are listed in US dollars and are subject to change without notice. Payment is due at the time of service unless otherwise arranged for package purchases.

We accept major credit cards, debit cards, and cash. We also offer Afterpay for purchases up to $2,000, subject to Afterpay's terms and approval.

Package purchases are non-refundable but may be transferred to another person with prior written approval. Packages expire 12 months from the date of purchase unless otherwise specified.

Results and Expectations

Results from our treatments vary from person to person and depend on various factors including individual body composition, lifestyle, diet, and adherence to recommended treatment protocols.

We do not guarantee specific results. Before and after photos shown on our website or marketing materials are representative of potential results but may not reflect typical results for all clients.

Assumption of Risk

By using our services, you acknowledge and accept that all treatments carry inherent risks, including but not limited to temporary redness, swelling, bruising, soreness, or skin sensitivity. Rare but possible risks include burns, scarring, or other adverse reactions.

You agree to follow all pre-treatment and post-treatment instructions provided by our staff. Failure to do so may affect your results and increase the risk of adverse effects.

Limitation of Liability

To the maximum extent permitted by law, Body By Helen LLC, its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services or website.

Our total liability for any claim arising from or related to our services shall not exceed the amount you paid for the specific service giving rise to the claim.

Intellectual Property

All content on our website, including text, images, logos, graphics, and software, is the property of Body By Helen LLC or its licensors and is protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our express written permission.

Photo and Video Consent

With your consent, we may take before and after photos or videos of your treatments for our records and potentially for marketing purposes. You may opt out of marketing use at any time. Any photos used for marketing will not include identifying information without your explicit consent.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our services shall be resolved in the courts of Miami-Dade County, Florida.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes are posted constitutes your acceptance of the modified Terms.
